The most exhausting thing about the misinformation about Deviantart taking root again is that it highlights how little people know about how copyright and copyright laws functions and that’s SO IMPORTANT for anyone doing anything creative at all.
Under copyright law as it stands now, every thumbnail, is making a copy,
every single temporary image that someone downloads via their browser,
is making a copy and is considered redistribution, as such DA needs the
right to reproduce (make copies of) and redistribute (in the form of the
files people download when they view the site) on their site otherwise
they cannot legally host your art at all.
If they do not have those rights, they cannot host your art and if that’s scary to you then you shouldn’t be using any hosting service at all.
All that scary sounding language isn’t that scary. Non-Exclusive? Means it you’re giving them a provisional right to it but it DOES NOT mean that you are locked to only them but also doesn’t means they have permission to transfer it either. Non transferable? Means they cannot give those rights to anyone else, you’re free to do whatever the heck you want. Reproduce and Redistribute? As I mentioned before that is what they need permission to do in order to make thumbnails, host images, and allow them to be viewed by other people. This is a required permission otherwise they cannot host your art at all, nothing can without it.
This is bog-standard contract work of any art gallery. Read Tumblr’s read Artstation, start reading the TOS and rights policy of every service you use, it’s the same language and the same rights and restrictions. The language also accounts for situations where someone takes a screen shot of the site for an article they’ll post that happens to have your thumbnail in it. It accounts for screen grabs of their galleries and other place when they make their own news posts to talk about a new feature. But none of those rights grant -commercial- permissions and none of their TOS grants them the right to sell those terms nor does it tell you what you can’t do with your own terms. DA’s terms of service are good and some of the most thorough and robust terms out there and they have no ownership of your work. Tumblr’s TOS is far more Dubious than DA’s ever has been so if you’re really that scared of DA then you should remove your whole archive from Tumblr as well.

just because you commissioned an artist doesnt mean you are a friend. We are doing a job like everyone else. So please dont do…filler convos?? Idk about other people but i try to keep it relaticely short and nice with commissioners. unless the artist specifies they are okay with it please dont try to force friend ship on someone. Its weird and for ppl with anxiety disorders it can get very uncomfortable.
The plan for the 17th, when the adult content ban comes in, is to protest.
To do that, we are making as much noise either side of the 17th as possible, and using the site as normal.
On the 17th, dead silence.
People are saying log off but what they really mean is don’t open the site or the app.
But, on the 17th make as much noise as possible on every other platform. Tweet about it and post on facebook and instagram and everywhere else.
What this does is causes a massive dip in ad revenue for one single day. That does not make staff think ‘oh everyone’s gone let’s shut down.’ What it actually makes them think is ‘oh shit people aren’t happy and if people don’t keep using our site we’re out of money and out of jobs.’
A boycott reminds a company that the users (consumers) have the power to make their site (business) worthless with one single coordinated decision.
If you want to join in, here’s what to do:
Do:
Close all open instances of the app and site on all your devices before the 17th
Make posts before and after the 17th on tumblr and other platforms, talking about why this ban is bad
Make posts on other sites during the 17th. Flood the official tumblr staff twitter and facebook with your anger and your opinion
Come back on the 18th and check in
Don’t:
Delete the app from your phone (this doesn’t affect their revenue and since it’s off the store at the moment it’ll be hard to get back)
Delete your account. I mean you can if you want to, but if you keep your account and don’t use it you’re saying to staff that there’s still time to save it. If you delete it’s hard work to come back.
Open the app or website (including specific blogs)
Make any posts (turn down/off your queue and make sure nothing is scheduled)
Go quiet elsewhere. Make it clear that this is just about tumblr, not a mass move away from all social media.
Remember: the execs don’t care about anything but money. Shutting down the site means there’s $0 further income from it. That’s their last possible course of action. If we make it clear we’re not happy, they’ll have to do something or we can do more and more until it becomes too expensive.
Protests take commitment. They’re a defiant action against a business that is doing something wrong. They will try to scare you into not participating, because they’re scared. We hold all the power here, sometimes the execs just need to be reminded of that.
